On May 17, 2023, SPBMCC Members David J. Dean, Esq. and John F. Nash secured a $1.25 million settlement for a man who tripped and fell while jogging on a public roadway.
An Evening Run Leads to Fall Before the Storm
During the late evening of Oct. 25, 2012, days before Hurricane Sandy wreaked havoc on Nassau County South Shore communities, our 49-year-old client was jogging when he tripped and fell on an uneven roadway. The roadway was the joint property of the municipalities of Long Beach and Hempstead.
Fall Leads to Multiple Surgeries and Permanent Injuries
Hurricane Sandy delayed the client’s medical treatment, but he eventually had surgery to correct a tear in his medial meniscus and anterior cruciate ligament (ACL) in his right knee. The client’s pain was treated with the medication Lovonox, which caused vascular complications throughout his body, requiring a prolonged period of recovery.
Members Dean and Nash Secure $1.25 Million for Plaintiff’s Injuries
While the defense argued that no one had reported tripping over the uneven roadway before, SPBMCC Members David Dean and John Nash argued that it probably did, but was unreported to authorities because it did not previously result in a serious injury to others. Our client was unable to return to his profession as a pharmacist and sustained lost wage damages. After the court determined Hempstead was negligent in failing to repair the asphalt, the case was settled prior to the damage trial in Nassau County Supreme Court for $1.25 million to cover the plaintiff’s damages for the injury and compensate him for lost wages.
