On April 25,2024, SPBMCC attorney Eleni Coffinas successfully secured a $7.9 million settlement on behalf of an infant plaintiff who sustained permanent brain injuries due to medical negligence during birth.

In April, our client presented to a hospital for delivery. For over sixteen hours prior to the delivery, fetal monitoring strips showed numerous variable and late decelerations, indicating that the infant was not receiving sufficient oxygen. Despite clear indications that the uterine environment was no longer safe, the defendants failed to recognize these warning signs and did not take timely action to deliver the baby via cesarean section.

As a result of this failure, the infant now suffers from cerebral palsy, spastic quadriparesis, and severe global developmental delays. The child will require assistance for all aspects of daily living and remains dependent on others for life. The plaintiff was also born with an unrelated skull malformation and some genetic issues.

The defense initially argued that the child’s skull malformation and genetic issues were responsible for the additional birth defects. However, the infant was born with good APGAR scores despite these conditions and only later developed signs of a Hypoxic Ischemic Injury (HIE) at birth. Eleni Coffinas demonstrated that had the child been delivered sooner, this injury could have been avoided.
