Eleni Coffinas, Esq., secured an $8 million settlement on behalf of a 40-year-old mother and infant plaintiff.
At 40-weeks pregnant, the plaintiff suffered a cord prolapse, a medical emergency requiring immediate delivery to restore oxygen flow to the baby. The mother called 911, and an ambulance transported her to the nearest New York hospital, despite her request to be taken to the hospital her doctors were affiliated with slightly further away.
The hospital the plaintiff was taken to was on permanent diversion for OB/GYN cases, as it lacked an Obstetrics and Gynecology unit and did not handle labor and delivery emergencies. Upon arrival, the hospital tried to make arrangements to transfer her to a hospital with an OB/GYN and neonatal, causing a critical delay in her care. After approximately 45 minutes at the hospital, the ambulance was authorized to take the plaintiff to the facility she initially requested to go to. Once there, she underwent an emergency Cesarean section.
Tragically, the delay in delivery resulted in prolonged oxygen deprivation for the infant plaintiff, leading to significant brain damage. The child, now eight years old, requires full-time care and resides in an institution that provides care and on-site schooling.
