Eleni Coffinas, Esq., secured a $13.5 million settlement on behalf of a 38-year-old married woman and mother of two, who presented to a hospital in New York on January 16, 2019, for the labor and delivery of her third child.

The plaintiff, who had uncontrolled pre-gestational diabetes, was admitted to the hospital and monitored for several hours. A plan was made for a trial of labor, including induction with Pitocin. Over the course of approximately 48 hours, plaintiff’s uterus was continuously stimulated with Pitocin, but there was no significant progression toward delivery. Eventually, her uterus became overstimulated, leading to a uterine rupture.

During labor, fetal monitoring strips repeatedly displayed late and variable decelerations—clear indicators that a timely delivery was necessary. However, the medical staff at the hospital failed to recognize the critical significance of these abnormalities. This delay resulted in the need for an emergency Cesarean section.

As a result, the infant plaintiff suffered oxygen deprivation in utero, leading to hypoxic-ischemic encephalopathy and severe, permanent brain damage. The plaintiff also endured significant physical and emotional harm due to the uterine rupture. She required blood transfusions, surgical repair, and treatment for infection. Additionally, the perforated uterus compromised her future fertility and resulted in a prolonged recovery period.
