A 42-year-old woman underwent fibroid removal surgery at a hospital in Brooklyn on September 29, 2017. During the procedure, an enterotomy (a hole in the bowel) was identified, and a surgeon was called to repair it. Following the surgery, the plaintiff was monitored by both her OB/GYN and the surgical team.

By October 2, the plaintiff had not experienced any bowel movements. The surgical team recommended a CT scan of the abdomen and pelvis with oral contrast to assess potential complications with her bowel. However, instead of performing the CT scan, the plaintiff was discharged.

On October 4, she returned to the hospital with a fever, abdominal pain, and vomiting. It was discovered that she had another hole in the bowel. This required surgery, removing part of her colon followed by the placement of an ileostomy bag. She subsequently developed a significant infectious abscess, necessitating a prolonged hospital stay.

The ileostomy was reversed on January 31, 2018, but the plaintiff endured an open abdominal wound until July 2018.
