SPBMCC Attorney James Wilkens Obtains Verdict of $3,500,000 for the Plaintiff in Medical Malpractice Case

On March 13, 2020, a Queens jury awarded $3,500,000 to a 31-year-old woman who now suffers from bowel problems as a result of medical malpractice by her medical care providers. SPBMCC Trial Counsel Jim Wilkens represented the plaintiff in the case.
Plaintiff Suffered a Laceration to her Rectum While Giving Birth
During the delivery of her first child in 2014, a woman suffered a laceration to her rectum. Though she underwent reparation surgery for the laceration, her rectum was not properly evaluated even though she continued to insist that she was having issues with her bowel movements during her hospital stay. The plaintiff also complained about her problem persisting when she visited her clinic where she went for a follow-up appointment. The patient, Mr. Wilkens’ client, was treated almost exclusively by residents with little involvement from experienced doctors, both at the hospital and at the clinic thereafter. Eventually, the patient sought a second opinion, which led to the discovery of an injury inside her anus. The delay in the diagnosis of this injury made it far too risky for the patient to undergo the necessary repairs.
Queens Jury Awards the Plaintiff $3,500,000 for her Pain and Suffering
The case ended in a verdict of $3,500,000 awarded to the plaintiff after the jury found that, had proper steps been taken by the hospital in charge of her treatment, the patient could have benefitted from a timely repair.
“Had the patient’s doctors initially detected the problem when she was in recovery from delivering her child, she could have undergone the repairs she needed in a timely manner,” said James Wilkens regarding the case. “Because the medical professionals in charge of her care did not provide the prompt treatment she needed, she now suffers permanent damage that drastically affects her day-to-day life. Thankfully, this positive verdict will help her be able to more easily handle the challenges that she may face as a result of her injury.”
